Pregnant women are entitled for three months pre-delivery and three months post-delivery paid leave. 2. Enterprises with creches must allow the mother minimum six creche visits daily. 3. Maternity Benefit (Amendment) Act, 2017 It provides for full paid absence from work for a period of 26 weeks (earlier 12 weeks) to take care of the child. Hence statement 1 is not correct. The Act is applicable to all establishments employing 10 or more women. For women who are expecting after having 2 children, the duration of paid maternity leave shall be 12 weeks. Hence statement 3 is correct. Maternity leave of 12 weeks to be available to mothers adopting a child below the age of three months from the date of adoption as well as to the “commissioning mothers”. The Act makes it mandatory for employers to educate women about the maternity benefits available to them at the time of their appointment. Any establishment which has 50 or more employees shall have the facility of creche. Further, the proviso of Section 11A states that employer shall allow 4 visits a day to the creche by the woman employee. Hence statement 2 is not correct.
